Terms of Service

Welcome to Coachat. By accessing or using the Coachat mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

1. Definitions

  • "Coachat" refers to the mobile application and all related services operated by Coachat.
  • "User" refers to any individual who accesses or uses the App.
  • "Coach" refers to fitness professionals who offer their services through the App.
  • "Subscription" refers to a paid plan that grants access to a Coach's services.
  • "Content" refers to workout plans, nutrition guidance, messages, and other materials provided through the App.

2. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You may register using Apple Sign In or email and password.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information during registration.
  • You are solely responsible for all activities that occur under your account.

4. Subscriptions and Payments

  • Subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions.
  • All subscription payments are final and non-refundable. Subscriptions cannot be canceled, changed, or refunded once the payment has been processed.
  • Subscription fees are charged on a monthly basis as indicated at the time of purchase.
  • Pricing may vary based on your region and the Coach's pricing structure.
  • By subscribing, you authorize recurring charges until you manage your subscription through your Apple ID settings.
  • To manage or cancel future renewals, go to Settings > Apple ID > Subscriptions on your device. Cancellation takes effect at the end of the current billing period.

5. Use of the App

You agree to use the App solely for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App for any unlawful, harmful, or fraudulent purpose.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of the App or its servers.
  • Attempt to gain unauthorized access to any part of the App or its systems.
  • Use the App to transmit any malicious software, viruses, or harmful code.
  • Scrape, crawl, or use automated means to access the App without prior written consent.

6. Prohibited Activities

The following activities are strictly prohibited on Coachat:

  • Prohibited Substances: the promotion, sale, distribution, or facilitation of any prohibited or controlled supplements, performance-enhancing drugs, anabolic steroids, or any substance banned by applicable law is strictly prohibited. Coachat has zero tolerance for such activities.
  • Using the App to promote, sell, or facilitate the distribution of any illegal or controlled substances.
  • Sharing or soliciting medical prescriptions or pharmaceutical products through the App.
  • Any form of harassment, abuse, or threatening behavior toward Coaches or other Users.
  • Posting or sharing inappropriate, offensive, or illegal content.

Violation of these prohibitions will result in immediate account termination without refund.

7. Health and Fitness Disclaimer

  • The App provides fitness and nutrition guidance for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
  • You should consult a qualified healthcare provider before beginning any exercise program, nutrition plan, or making changes to your health regimen.
  • Coachat and its Coaches are not liable for any injury, illness, or adverse health outcome resulting from the use of workout plans, nutrition advice, or any other Content provided through the App.
  • You acknowledge that physical exercise carries inherent risks and you participate at your own risk.

8. Intellectual Property

  • All content, design, logos, trademarks, and intellectual property within the App are owned by Coachat or its licensors.
  • Workout plans, nutrition guides, and other Coach-created content are the intellectual property of the respective Coach or Coachat.
  • You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent.

9. User Content

  • You retain ownership of content you submit (e.g., profile information, messages to Coaches).
  • By submitting content, you grant Coachat a non-exclusive, worldwide, royalty-free license to use, display, and process such content as necessary to operate the App.
  • You are solely responsible for the content you submit and warrant that it does not violate any third-party rights.

10. Limitation of Liability

  • To the maximum extent permitted by law, Coachat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Coachat's total liability shall not exceed the amount you paid in subscription fees during the twelve (12) months preceding the claim.
  • Coachat does not guarantee the accuracy, completeness, or reliability of any content provided by Coaches.

11. Termination

  • Coachat reserves the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any conduct that Coachat determines is harmful to the App or its users.
  • Upon termination, your right to use the App ceases immediately.
  • Termination due to violation of these Terms does not entitle you to any refund.

12. Modifications to Terms

Coachat reserves the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kuwait.
